Terms of service

These Terms of Service (hereinafter referred to as the “Terms”) set forth the terms and conditions for the use of the online shop provided by Honmyozan Takada Kantsuji Temple (hereinafter referred to as “the Temple”) on this website (hereinafter referred to as the “Service”). Registered users (hereinafter referred to as “Users”) shall use the Service in accordance with these Terms.

Article 1 (Application)

These Terms shall apply to all relationships between Users and the Temple relating to the use of the Service.

In addition to these Terms, the Temple may establish various rules and other provisions regarding the use of the Service (hereinafter referred to as “Individual Provisions”). Regardless of their name, such Individual Provisions shall constitute a part of these Terms.

In the event of any inconsistency between the provisions of these Terms and the Individual Provisions, the provisions of the Individual Provisions shall prevail, unless otherwise specified therein.

Article 2 (User Registration)

In connection with the Service, user registration shall be completed when a person wishing to register agrees to these Terms, applies for registration in accordance with the method prescribed by the Temple, and receives notification from the Temple approving such application.

The Temple may refuse to approve an application for user registration if it determines that the applicant falls under any of the following circumstances, and shall have no obligation to disclose the reason for such refusal:

  • The applicant has provided false information when applying for registration.
  • The application is submitted by a person who has previously violated these Terms.
  • The Temple otherwise determines that the registration is inappropriate.

Article 3 (Management of User IDs and Passwords)

Users shall manage their user IDs and passwords for the Service at their own responsibility.

Under no circumstances may Users transfer or lend their user IDs or passwords to any third party, or share them with any third party. If a login is made using a combination of a user ID and password that matches the registered information, the Temple shall deem such use to have been made by the User registered under that user ID.

The Temple shall not be liable for any damages arising from the use of a User’s user ID or password by a third party, except in cases where such damages are caused by the Temple’s willful misconduct or gross negligence.

Article 4 (Sales Contracts)

In connection with the Service, a sales contract shall be deemed concluded when a User applies to the Temple for the purchase and shipment of a product, and the Temple notifies the User that it has accepted such application. Ownership of the relevant product shall transfer to the User when the Temple delivers the product to the shipping carrier.

The Temple may cancel the sales contract described in the preceding paragraph without prior notice to the User if the User falls under any of the following circumstances:

  • The User violates any provision of these Terms.
  • Delivery of the product cannot be completed due to an unknown delivery address or the User’s prolonged absence.
  • The Temple otherwise determines that the relationship of trust between the Temple and the User has been impaired.

Payment methods, shipping methods, methods for cancelling purchase applications, return procedures, and other matters relating to the Service shall be governed by methods separately prescribed by the Temple.

Article 5 (Intellectual Property Rights)

The copyrights and other intellectual property rights relating to product photographs and other content provided through the Service (hereinafter referred to as the “Content”) shall belong to the Temple, content providers, or other legitimate rights holders. Users may not reproduce, repost, modify, or otherwise make secondary use of such Content without authorization.

Article 6 (Prohibited Acts)

In using the Service, Users shall not engage in any of the following acts:

  • Acts that violate laws or public order and morals.
  • Acts related to criminal activities.
  • Acts that infringe copyrights, trademark rights, or other intellectual property rights contained in the Service.
  • Acts that destroy or interfere with the functions of the Temple’s servers or networks.
  • Acts that commercially use information obtained through the Service.
  • Acts that may interfere with the operation of the Temple’s services.
  • Unauthorized access or attempts to gain unauthorized access.
  • Acts of collecting or storing personal information or other information relating to other Users.
  • Impersonating another User.
  • Acts of directly or indirectly providing benefits to antisocial forces in connection with the Temple’s services.
  • Any other acts that the Temple deems inappropriate.

Article 7 (Suspension or Interruption of the Service)

The Temple may suspend or interrupt the provision of all or part of the Service without prior notice to Users if it determines that any of the following circumstances exists:

  • Maintenance or updating of the computer systems relating to the Service is required.
  • Provision of the Service becomes difficult due to force majeure, including earthquakes, lightning, fire, power outages, or other natural disasters.
  • Computers, communication lines, or other systems are suspended due to an accident.
  • The Temple otherwise determines that the provision of the Service is difficult.

The Temple shall not be liable for any disadvantage or damage suffered by Users or third parties as a result of the suspension or interruption of the Service, regardless of the reason.

Article 8 (Restriction of Use and Termination of Registration)

The Temple may, without prior notice, restrict a User’s use of all or part of the Service or terminate the User’s registration if the User falls under any of the following circumstances:

  • The User violates any provision of these Terms.
  • It is discovered that the User provided false information in the registration details.
  • A credit card registered by the User as a payment method becomes unavailable or suspended.
  • The User fails to fulfill payment obligations or other obligations.
  • The User fails to respond to communications from the Temple for a certain period.
  • The User has not used the Service for a certain period since the User’s last use.
  • The Temple otherwise determines that the User’s use of the Service is inappropriate.

The Temple shall not be liable for any damages incurred by a User as a result of actions taken by the Temple pursuant to this Article.

Article 9 (Withdrawal from the Service)

Users may withdraw from the Service by completing the prescribed withdrawal procedures.

Article 10 (Disclaimer of Warranties and Limitation of Liability)

The Temple makes no warranty that the Service is free from factual or legal defects, including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, or infringement of rights.

The Temple shall not be liable for any damages incurred by Users as a result of the Service. However, if the contract between the Temple and a User relating to the Service (including these Terms) constitutes a consumer contract as defined under the Consumer Contract Act of Japan, this disclaimer shall not apply. Even in such cases, the Temple shall not be liable for damages arising from special circumstances, including circumstances that the Temple or the User foresaw or could have foreseen, among damages incurred by the User as a result of the Temple’s default or tort caused by ordinary negligence (excluding gross negligence).

The Temple shall not be liable for any transactions, communications, disputes, or other matters arising between Users and other Users or third parties in connection with the Service.

Article 11 (Changes to or Discontinuation of the Service)

The Temple may change the content of the Service or discontinue the provision of the Service without notice to Users, and shall not be liable for any damages incurred by Users as a result thereof.

Article 12 (Amendments to These Terms)

The Temple may amend these Terms at any time without notice to Users if it determines that such amendment is necessary. If a User begins using the Service after these Terms have been amended, the User shall be deemed to have agreed to the amended Terms.

Article 13 (Handling of Personal Information)

The Temple shall appropriately handle personal information obtained through the use of the Service in accordance with the Temple’s Privacy Policy.

Article 14 (Notices and Communications)

Notices and communications between Users and the Temple shall be made in accordance with methods prescribed by the Temple.

Unless a User submits a notice of change in accordance with the procedures separately prescribed by the Temple, the Temple shall deem the User’s currently registered contact information to be valid and may send notices or communications to such contact information. Such notices or communications shall be deemed to have been received by the User at the time they are sent.

Article 15 (Prohibition of Assignment of Rights and Obligations)

Users may not assign, transfer, or offer as security their contractual status or any rights or obligations under these Terms to any third party without the prior written consent of the Temple.

Article 16 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) shall be excluded with respect to the Service.

In the event of any dispute arising in connection with the Service, the court having jurisdiction over the location of the Temple’s principal office shall have exclusive agreed jurisdiction.
